Old Barclaycard Debt Passed on to Cabot

Options
Hi All,
Hope this is the right place for this. I had 2 Barclaycard Credit Cards plus others back in 2013, at the worst point I was in £25K worth of credit card debt. Since then in 2018 Barclaycard closed my cards (can't remember the term) and passed me to Barclaycard debt management this was fair enough, I couldn't make the required payments any longer. I agreed on a monthly amount for both credit cards and paid down most of the debts. During this time they wrote to me and refunded some money which was 1-2K on one of them because of some mistake they were owning up to.

All went well for a few years I struggled to pay the agreed amounts until one month the payment went unpaid due to lack of funds in my bank account that the DD was paid from. They cancelled the arrangement and I then recieved letters from a number of debt collection companies (Wescott was one), rightly or wrongly, I ignored several of them and they went away after anything from a few weeks to a few months. I have now been contacted by Cabot who have purchased the debt, I have ignored them, I dont think I have logged into the online portal which has been tempting but wasn't sure if this was to be advised. They currently write occassionaly and phone every couple of days, today they have stepped this up and now a very similar message is being left by Mortimer Clarke solicitors who are or work for Cabot apparently.

I now owe just under £2K, I could make an arrangement to pay it off, I am somewhat unwilling due to the way Barclaycard have treated me, If I had the full amount I think I'd just pay it off for a peaceful life, I don't have the money but could make payments.

So (sorry for waffling) the question is, What do I do?

Make Payment and set payment arangement?
Continue on my curent ignoring trajectory?

I had 2 defaults on my credit report from the original Barclaycard Defaults, these have now dropped off as far as I can see

If I was to settle partially or fully, would this show up on my credit report?
How long can Cabot pursue this?
Can Barclaycard take any further action?
Presumably, Cabot can sell this on to another company? If so how long does this go on for?

Anyone who has been in a similar position or who knows anything about this, I would be really grateful to hear what y best course of action would be.

When did you last make a payment or acknowledge the debt in writing?

For now, you do nothing. Continue to ignore

If it's been less than 6 years since you last paid or acknowledged/admitted the debt then they can go for a CCJ which will then stay on your file for another 6 years.

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

Thank you for your reply. Having now had a look, I made payments in 2020 to AIC for this debt. So I assume Cabot can pursue a CCJ against me?

As it's acknowledged, it's enforceable so yes they could if you refuse to pay You could try a full and final offer and see what they say, lowball under 50% and you might get lucky - they can't add the default etc back on so it's worth a gamble

They could start a court claim against you.

They must first send a formal pre action letter with reply form and 30-day limit.

They are a long way from getting a ccj.

Hi - I had a 12k debt sold to Cabot and they took me to court. I paid a solicitor to defend the claim and they dropped the claim and wrote it off. Turned out that Cabot did not actually have any evidence and had not followed the procedures.. Happy to share the defence my lawyer prepared if its any help.

The normal process is to request the CCA long before court is needed, if they can't produce it, the debt is unenforceable
