I have read pages and pages but I am at a brick wall with Saba PCN

I am a new member but have been reading things for weeks regarding Saba charges.

My situation up until now, a friend of mine got 2 window stickers on their car for parking at a station in the west midlands and not paying. Payments were made for both days, but the stickers had already been applied so irrelevant. (one was 10th November the other 8th December).

Following advice of the forum, they ignored, no contact made following sticker, NTK, and then the ZZPS letters and emails/phonecalls.

Today they've had an email (maybe a letter too, this is all going to their old address and sometimes being forwarded on) from BW Legal. This one threatens court action, and is for the first fine, so can only assume the same will happen with the next fine.

Their problem is, ignoring is always advised but then when we have looked into BW Legal some people are talking about court dates/defences and also CCJs, which they cannot risk as mortgage soon.

His 2 questions are:
First, can he contact to update his address, to make sure any letters are at least being seen by him? or will this impact things/

Second; can he continue to ignore BW legal or does it get tricky here? They've currently given a date in April, 20th approx to pay this and he just can't get a CCJ. 

Thanks and I am sorry for starting a new thread but I am out of answers from the forum currently. We really thought ignore for 6 months and it would go, but the date given is 1 month before its 6 months. So he is unsure if the 6 month rule still applies when passed over?

    6 month rule does not apply ( as far as I'm aware )

    Have you read the newbees thread?

    The letter from BW Legal is this a letter before claim?

    You can't get a CCJ unless:

    1. You go to court
    2. You lose in court
    3. You don't pay

    If stuff has gone to an old address probable because of a non-updated V5 you must make them change this - again the exact wording is in the new bees thread.

    @DE_612183 thank you. I have read the newbies thread but won't lie feel like I'm struggling to understand in this circumstance. 

    Who do we contact to update that though? As everything I see says just ignore the debt collectors. 

    I haven't seen an actual letter if they've sent one. but the email is pretty much an introduction, and an offer to pay monthly. They want me to go onto their portal to reply or acknowledge. Just using scarier terminology. 

    Thanks again we feel stuck and any guidance is really helpful.

    Send a rectification notice to the DPO of SABA and BW Legal instructing them to erase your personal data and replace it with your current address for service.
    Make sure you use the word I have highlighted as it has a specific meaning where data processing is concerned.

    @DE_612183 thank you. Will email both DPOs now and then await further correspondence to correct address.

    I assume then if they do try and proceed with a claim, I just follow the newbie pages guidelines again. My main worry was giving them address and messing it all up.

    More (or equally) important is for your/your friend to update the V5C; failing to do so could lead to a £1,000 real fine!

    Were the SABA tickets 'Penalty Charge' notices or 'Parking Charge' notices - important difference?

    Why not just read the other SABA thread today with Moorside Legal?

    That explains why we need to know if these were  'Penalty Charge' notices or 'Parking Charge' notices ... and saves us repeating ourselves. The 6 month/6 year question depends on the answer.

  • Thanks for the comments. I do not have the initial window stickers, the letter he has states a 'Penalty notice number' and also 'a penalty notice was affixed to the above-mentioned vehicle'

    But then also on the website to pay its referred to as a 'parking charge number' so i am sorry but I am unsure on how to fully know which one. The letter also refers to the railway bye laws, and breaching bye law 14. If that helps.

    Also the v5 has now been updated but appreciate the heads up there too.

    In that case it was almost certainly issued as a 'Penalty Notice' which is totally unenforceable. 

    Per the message above there now seem to be cases where SABA are trying to switch from a Penalty Notice to a Parking Charge Notice which is ludicrous. 

    The other thread referenced above is relevant, though your case may not go the same way. 

    I would offer you odds of 99.99% you will never pay a penny for this. There is zero risk of CCJ. 

    I think you were asked and didn't answer above - is the most recent communication a Letter Before Claim? It may be useful for you to post a copy here (with personal information redacted).
