DCBL County Court Claim

Hi everyone, I know this is a frequently asked topic but there were so many threads regarding this I’d appreciate a but of guidance. I have received a county court claim for a parking ticket (£170) through DCBL in behalf of Parking Eye. The offence happened in January this year, I have recieved the fine in my old address before it was changed and then they found my new address and forwarded to me, I contested the fine several times, the free limit is 2 hours (this is in my towns center) and according to the camera I overstayed 26 minutes. my issue is that I checked the ticket machine by inputting my details and it said I was still within the time and didnt have to pay anything. I have appealed through Parking eye and POPLA but was denied both times, I had attached facebook posts in my appeal from other town residents complaining about similar issues with the machines and also about the traffic leaving the center. Also worth nothing that there were some repairs undergone for the camera maybe 2 weeks before as they werent working for a few months before that, but from what I gathered most peoples fines have been cancelled. What should I do in this scenario? I have a week to respond to the county claim which is now £270. I appreciate any help in this!

    DCB Legal,  not DCBL  ! , on behalf of Parking Eye 

    It wasn't a fine,  it was an Invoice issued by Parking Eye for the alleged breach of the parking contract on that private property , a supposed overstay 

    Post the issue date on the claim form,  top right 

    Post a redacted picture of the POC on the lower left of the claim form after hiding the VRM details only first 

    Study other recent Parking Eye via DCB Legal defences too

    You just defend it same as all the other DCB Legal ParkingEye claims, using the special starting words and Chan & Akande authorities.  This is all in the Template Defence thread.

    Very easy.

    But how on earth can a PCN dated January that first went to an old address, then was appealed to PEye (once readdressed) then appealed to POPLA which takes 2 months, possibly have resulted in a Claim Form dated early March? Impossible surely? You mean PCN dated January 2024?

    Thanks for your advice, I will have a look at that, so I should defend all parts of the claim?

    Login to the government gateway and navigate to MCOL and do the AOS online ASAP,  nothing else,  then draft your defence according to the reply above

    With those POC being so sparse, you can use the Chan & Akande defence as well as the DCB Legal bit as advised above.  See here: -

    Yes we know what it means. All these stages are already covered in the first 12 steps and we don't need to see the first standard letters. Just follow the first 12 steps in the Template Defence thread.
