Deposit refund and other issues on car purchase
Options
A friend has got herself into a pickle with a local dealership and I would like to get some input as to her best way forward. She decided to look into changing her car (used and on finance) and went to the dealer to have a look at one. She liked it and after the calculations had been done decided she could afford it so did the paperwork and paid the £500 deposit. After though she decided that she didn't want to go ahead with the deal and informed the sales rep. He told her that the deposit was non refundable and suggested a different car they had which would cost her a bit less and he could null and void the original agreement and start a new loan for the second car. He told her over the phone that she would only be paying £20 a month more for this second car. When he next spoke to her he said there had been a mistake and she would have to pay £70 a month more. She will struggle with this but now doesn't know what to do as she thinks she can't get her deposit back for the first car agreement. My questions are - can she get her original deposit back, and how will they merge the original loan with the second one (when she signs the paperwork). Also do they reduce the loan agreement by the £500 deposit already paid if she does go ahead with it? Many thanks.

It may be better if the friend can put their own content to the forum so that details are correct.
Anyway, the friend saw a car and decided she could afford it.
Then she changed her mind.
Then the Dealer suggested a "different car they had which would cost her a bit less"
But that different car would "only be paying £20 a month more" which later became "£70 a month more"
How can £70 (or £20) per month more be costing her less?
As for the deposit, what were the terms relating to that on the order paperwork when it was signed?
It is common that cancelling the order would mean forfeiting the deposit, but we cannot see the details in the terms that were agreed to.1
