Hi, 

Im new here and need help please. 

I have received a Court Claim from Moorside Legal regarding a UKPS parking ticket dating back to 2022! 

I'am defending this as the original letter from UKPS in 2022 is missing crucial information.. 

The defence: 

To Whom It May Concern,

I am responding to the notice ****** issued to the vehicle ****** by UKPS.

POFA 2012 Compliance

The notice does not state the period of parking

The notice has not been issued according to POFA 2012 Schedule 4 namely:

6(1)The second condition is that the creditor (or a person acting for or on behalf of the creditor)—

(b)has given a notice to keeper in accordance with paragraph 9.

9(1)A notice which is to be relied on as a notice to keeper for the purposes of paragraph 6(1)(b) is given

in accordance with this paragraph if the following requirements are met. (2)The notice must—

(a)specify the vehicle, the relevant land on which it was parked and the period of parking to which

the notice relates;

(3)The notice must relate only to a single period of parking specified under sub-paragraph (2)(a) (but

this does not prevent the giving of separate notices which each specify different parts of a single period of

parking).

The notice issued does not state the period of parking and therefore it has not been issued correctly

under POFA 2012 Schedule 4.

Evidence Requested

1. Proof of authorisation from the land owner for the operator to act as creditor at the contravention

location with signatures from both parties.

2. Signage Photographs: Two signs are requested, (i.) the entrance sign and (ii.) the sign showing the full

terms of contract with the driver which were at the location on the contravention date

I look forward to hearing from you and I sincerely hope we can resolve this matter.

***Moorside Legal are not accepting this and now have sent images with times and date of the incident ( these were not on the original letter from UKPS in 2022 ) only the entry time / date of vehicle***

They are now threatening court action! 

Please advise on my next steps

What is the Issue Date on your Claim Form?

Can you please show us a picture of the Particulars of Claim - with all your personal detail hidden of course.

Have you filed an Acknowledgment of Service?
If so, upon what date did you do so?
Your MCOL Claim History will have the definitive answer to that.
