HMO Scotland

Hi Everyone,
Eldest is flat hunting in Scotland with some friends and has a couple of options. I know if they rent a flat with three or more it needs to be an HMO. A friend owns a flat and could rent either one or two rooms as big living kitchen -  does that also need an HMO if it is owner occupied? Think they have all the safety things but no licence as only ever been 2 in the flat. I couldn’t find much online about this second scenario specifically for Scotland where the regs seem to be tighter.
