Attendance Allowance and deferred payment

I wonder if anyone has any experience of this? My cousin has terminal cancer and is self-funding his care. He has a property and we are in the process of applying for a deferred payment from the Council, whereby they put a charge on his house. He applied for AA a few months back on the fast track system and has recently been awarded it but has been told this will stop when the deferred payment kicks in. The DWP have told him that the AA will accrue and that the executor will be able to claim it back when he dies and the house is sold. This seems diabolically cruel and stupid and contrary to the whole point of AA. I've called DWP just now and this seems the be the policy. Is there no way around this?

    AA should continue if full cost/self funding,  regardless of whether DPA in progress.  Has CHC been applied for?

    Can you claim Attendance Allowance in a care home?

    You can claim Attendance Allowance if you are a self-funder and pay for all care home costs on your own.

    You cannot usually get Attendance Allowance if you live in a care home and your care is paid for by your local authority.

    If you live in a nursing home and only receive NHS-funded nursing care (FNC) to help with costs, Attendance Allowance will continue to be paid. However if you are receiving Continuing Healthcare (CHC), your Attendance Allowance will stop after 28 days of getting CHC.

    If you have been diagnosed with a terminal illness, you can still receive Attendance Allowance if you live in a hospice.

    Thanks for this. We have applied for CHC but it has not been awarded. I called the DWP today and was told quite firmly that his AA would be stopped if he got the deferred payment and could only be claimed back bafter his house was sold, which would almost certainly be by the executor,after he had died. I have requested a manager look into this. I am more than ever convinced they are wrong. It has caused him a lot of distress today. The whole point of AA is surely to help at a time of need, not when you are dead?
