Smart Parking appeal refused ---(didn't reveal the driver's name in the appeal letter)

    I wonder if Smart Parking passes the case to debt collectors, will it affect my credit score? As I am going to apply for a mortgage soon, I am worried it may complicate the mortgage application.

  • Hello all,

    I finally received the formal rejection by Smart Parking and was given a POPLA code today, as predicted by @Gr1pr:)

    I have got on POPLA website, and wonder which ground shall I use please?  ( I parked the car in a retail car park and over stayed for 11 minutes--without realizing the time)
    On the website, the section Grounds for appeal

    My vehicle was stolen

    I was not improperly parked

    The amount requested on the parking charge notice is not correct.

    I was not the driver or the registered keeper of the vehicle at the time of the alleged improper parking.


    Other grounds for appeal

    Appeals based solely on the following grounds for appeal are less likely to be successful

    Extreme circumstances prevented me from parking correctly.

    Other

    The section reason for appeal
    I am going to put "This operator has no contract at this site to issue PCNs" . 

    Any advice would be very much appreciated.

     POPLA appeal was sent ! I will update the result when it arrives. :)

    I want to say a heartfelt thank you to all of you who guided me and provided me help and support through the process of fighting back with Smartparking. Here is the reply from POPLA 

    The operator has contacted us and told us that they have withdrawn your appeal.

    If you have already paid your parking charge, this is the reason your appeal will have been withdrawn. Unfortunately, you cannot pay your parking charge and appeal, which means that POPLA’s involvement in your appeal has ended. You will not be able to request a refund of the amount paid in order to resubmit your appeal to us.

    If you have not paid your parking charge, the operator has reviewed your appeal and chosen to cancel the parking charge. As the operator has withdrawn your appeal, POPLA’s involvement has now ended and you do not need to take any further action.
