2-for-1 deal consumer rights


I recently took advantage of a 2-for-1 glasses deal and ordered two pairs. Both have arrived in-store, but unfortunately, one pair is damaged, and the style is no longer available for a replacement. The store has offered me two options: either accept the damaged pair with a 10% discount on the total cost or choose an alternative frame to replace them.
However, if I can’t find a suitable alternative and don’t want to accept the damaged pair, what are my rights regarding a refund, given that the purchase was part of a 2-for-1 promotion?

To clarify, this is on the basis that only one pair of the 2-for-1 glasses ordered are fit for purpose. Can anyone advise on the refund position?0

Does that not mean the contract is void so you need to return the other pair to get a refund of what you paid?
You can then buy the original pair as a single purchase or go elsewhare to maybe get the same deal with glasses you like.

If they can't supply precisely what you ordered then they must cancel the sale and refund you in full, if that is what you wish, so you are left with your money back (but no glasses). That's your consumer rights under the consumer rights act 2015. You've no entitlement to anything more.
However that would leave them with two pairs of glasses they can't sell and don't really want, so you are in a good position to bargain.
I would be pleasant and polite and start by asking for 50% reduction to just take the pair you want. Half a sale is better than no sale at all.
If that doesn't work, see if they might give you your second pair in frames from a slightly higher price band?1 -

Where you order more than one item and one item has an issue you may either reject everything for a full refund or reject just the one item for a refund of that item.

Thanks for your replies. These are much appreciated. Initially I’ll see if I can find an alternative style which they can supply instead. If that’s not going work, I’ll try to negotiate a discount, one better than the 10% already offered. 50% sounds like a pretty good starting point! And my last resort will be to request a full refund as they have been unable to supply precisely as ordered. So, I now have a plan!Thanks again for your comments. Really helpful!0
