Letter of Claim - BW Legal

Hi everyone, I received a letter of claim from BWlegal dated 10 March 2025, demanding £170. Here are the details:
- Date of contravention: 2 July 2022
- Their client: Smart Parking Ltd
This is the first time I’ve been notified about this fine, and I don’t even recall why I received it since it happened nearly three years ago. I do remember getting two fine notices from Smart Parking in 2022, both of which I successfully appealed. (Seems they were pretty busy during Covid!)
For some extra context: I moved house in October 2022, and it looks like they’ve now tracked down my new address.
After checking the newbie thread and with some assistance from ChatGPT, I’ve drafted a response letter to BWlegal. I just want to double-check if it’s good to send as is. Could you let me know if I’m on the right track? Thanks!
And should I send a complaint letter to Smart Parking and the BPA since I never received the original fine notice? Thanks!

Dear Sir/Madam,
I am writing in response to your initial notice regarding the above-referenced matter, which I received directly from BW Legal. This is the first correspondence I have received concerning this alleged parking charge, and I wish to make it clear that I have never received the original Parking Charge Notice (PCN) from Smart Parking. I was entirely unaware of this matter until receiving your letter, which appears to escalate immediately to a court-related stage without any prior notification. This lack of prior correspondence is concerning and unjustified.
I formally dispute the debt you are claiming. I do not accept liability for this charge, nor will I make any payment unless you can provide clear and lawful evidence to substantiate your claim. To that end, I request the following information as a matter of urgency:
- A copy of the original PCN allegedly issued by Smart Parking in relation to reference TCXXXXX.
- Evidence of the alleged contravention, including photographic proof and timestamps.
- An explanation as to why no prior correspondence was sent to me before this escalated notice from BW Legal.
For clarity, I have a history of responsibly addressing parking-related matters. I successfully appealed two previous PCNs from Smart Parking—reference numbers TCXXXX (received 17 February 2022) and TCXXX (received 24 September 2022) — after persistent follow-ups on my part, as it often took Smart Parking upwards of six months to respond to my appeals. This demonstrates my diligence in engaging with such matters when properly notified. However, in this instance (TCXXXX), I have received no communication from Smart Parking whatsoever. The first I learned of this alleged charge was through your notice, which appears to be a court-related letter. This sequence of events does not make sense and raises serious questions about the validity of your claim.
Until you provide the requested documentation and evidence, I consider this charge disputed and will not accept any liability. I urge you to supply the original PCN and the supporting evidence as soon as possible so that I may assess the situation properly. Please treat this as a formal request under my rights to understand and challenge the basis of your claim.
I look forward to your prompt response within 14 days of this letter. Should you fail to provide the requested information, I will have no choice but to escalate this matter further, including raising concerns about the procedural fairness of your approach.
