Scotland - Private Parking fine issued to owner not driver

Hi all
Looking for some advice with regards to avoiding partner having to go to court - he advised me to ignore the letters they sent him as I was the driver - however they are now going to take him to court through lawyers.
If, as I wish him to, he names me do they have to begin the process again offering me the 21 day discount when they contact me - so £60 - or does that stay at the £170 it is now
Getting bit worn down with it all

OK show us the front page of what you have received so we can stick with facts not assumptions
No one cam guess if they have no idea what you received1 -
it was an ANPR fine for parking on Private car park for 13 minutes - I am not the owner of the van - I was the driver that day, sorry I will not be posting any front page of any identifying documents for anyone :0
-
Is the word 'fine' anywhere to be seen on what your husband has received?
I very much doubt it.2 -

IF THE EVENT TOOK PLACE IN SCOTLAND OR NORTHERN IRELAND, WE SUGGEST YOU DO (ALWAYS!) COMPLAIN TO STORE MANAGEMENT IF YOUR PCN IS FROM A RETAIL PARK, AND SEND THE USUAL TEMPLATE APPEAL FOR YOUR CASE, NOT SAYING WHO WAS DRIVING. HOWEVER, DO NOT TRY POPLA BECAUSE POPLA (IN A CASE THAT TOOK PLACE OUTSIDE ENGLAND/WALES) WILL REQUIRE YOU TO STATE IF YOU WERE DRIVING OR NOT, AND THAT IS THE ONE THING NOT TO DISCLOSE.1 -
It'll just be yet another tedious Moorside Legal BW Legal, DCB or similar £170 threatogram trying to trick unwary people in Scotland into panicking.
Is it just daft old Smart Parking?
Read the forum. TOTALLY IGNORE.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Follow Coupon-mad's advice above you are in Scotland the last thing you want is to identify the driver. You also need to get your thoughts and facts together, you have no "fine" it's a speculative charge concocted by a private company, and they have issued nothing to "the owner" even the DVLA has no idea who the owner is and again the paperwork does not say owner I am willing to bet!2

Are they planning on taking you to the county court and get a county court judgment? If so that won't be happening. We've no County Courts in Scotland we have Sheriff Courts. The County court system only applies to E and W.1
