Music Magpie Phone Rental

Options
I started renting phones with music magpie 5/6 years ago. The accidental damage cover was a big appeal to me and the reason I stayed renting. For the first time I've got to claim for accidental damage on my current phone but have been informed that because I upgraded after sept 2021 the accidental damage is no longer part of the contract. This was never mentioned in my upgrades since 2021 as I would have terminated the rental at that point as that insurance was the main reason for renting.

They are telling me that I have to get the phone repaired by manufacturers and then also pay 75% of the value on return. I've asked can I buy the phone as the damage does not affect the phones use in any way is purely cosmetic but they won't allow this. Because the phone is a older model repair costs are fair more than what it's worth now and I'd have no problem paying but as I won't own the phone at the end and have paid fair more than the value of the phone when it was brand new I feel that I've been very cheated. Is there anything I can do to lessen what I have to pay?
Thanks

Why do you need to pay 75% on return if you have repaired the phone? Have you received any terms and conditions from them? Scour your email box

I suspect you've missed or didn't read the revised contract, so that element is perhaps your mistake to bear.

It doesn't seem right that you have to pay for the repair AND provide them with 75% of the phone's value, though.  That sounds like betterment for them.  What does the contract say?

This is what they say upfront on their website:

    Rental FAQs
Do I own the device at the end of my rental agreement?
No, the device is offered on a rental agreement and remains the property of musicMagpie throughout.
Can I offer to buy the device during or after my agreement?
We want to keep our rental devices in circulation for as long as possible to help protect the planet, so we don’t offer them for purchase during or after your rental.
What happens if I break or damage my device?
Your device isn’t covered for accidental damage, so we’ll need to take a payment equivalent to the remaining months left on your rental and the existing retail value of the device.
Any technical faults are covered by our lifetime warranty.

I presume the '75% of the phone's value' is their calculation
equivalent to the remaining months left on your rental and the existing retail value of the device.
    Is that correct @Zero45?

Unfortunately I have obviously missed the accidental insurance no longer being part of the rental agreement, I do feel something like that should be flagged a but more but that is my mistake.

On top of the 75% of value they also want a £50 cancellation fee and 75% of the value on the website for a similar phone is over double what I have left to pay. If it was just the remaining months to pay that would be fine I can undertstand that. Im just struggling to get my head around getting the phone fixed and then having to pay more than what they'd be reselling it for.

Sadly I think this is one to out down to experience but was hoping someone might have a solution. Thanks
