Private Parking Ticket

Kitten_cat

I have unfortunately had 2 private tickets over 15 years ago. I ignored them and they each sent 3 letters and stopped. I got a parking ticket in November from a motorways services. I had parked in a disabled bay and displayed my disability card. I was under the impressive that disabled parking is free and unlimited. Any signs were not obvious. I have received 5 letters, the last one, threatening court and CCJs. I thought that if you replied, it acknowledged their right to fine you. Is that right? Should I hold my nerve or something else?

Magistrates issue fines, so not applicable here
The word FINE wont appear on any of the paperwork
The blue badge rules dont apply on private property or leased areas like an MSA
Its not free and not unlimited ( read your blue booklet ), it's a free minimum 2 hours at MSAs, after 2 hours payment is required
The signs form the contract, including limitations, so read them carefully
The claimant Parking company can issue a court claim against you within the 6 years following the incident date, using MCOL. If you lost in court it would be enforceable and payable, or you get a CCJ against you
So all of the post was hogwash4 -

You could try plan A from the newbies thread on here as a starter and read the rest of the information it will enlighten you.You must stop making up your own rules about parking (which is basically what you have done) the days of cuddly retired gents in white coats sitting in a hut controlling parking have disappeared. It's now a cash cow run for profit with traps and hurdles everywhere. The moral is find the signs and read them!4

To be clear: NO PAYING IT!Kitten_cat said:I got a parking ticket in November from a motorways services. I had parked in a disabled bay and displayed my disability card. Is it from Group Nexus or from ParkingEye?
Try a complaint to the MSA manager, stating that the 2 hour limit makes no allowance for the extra time ('reasonable adjustment') that disabled persons are entitled to, before they'd have to pay a tariff.
Equality Act 2010 allows you more time. Here's a case settled soon after the Equality Act came in, which forced Councils to allow blue badge holders at least an extra hour:

Other councils offer similar adjustments of time as mandatory policy to comply with disability law, in place for 15 years now...
...ahem... parking firms must do the same, by law. But they don't, which is currently illegal.
The MSA can cancel it.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
