Dear Sir/Madam,
As the registered keeper, I am writing to dispute Parking Charge Notice [PCN Reference Number], issued to vehicle [Vehicle Registration] at [Car Park Name] on [Date].
Grounds for Dispute
- Non-Compliance with the Protection of Freedoms Act 2012 (POFA)
As the registered keeper of the vehicle, I note that the Notice to Keeper (NTK) does not appear to be fully compliant with Schedule 4 of the Protection of Freedoms Act 2012 (POFA). Specifically, the NTK fails to meet all the necessary conditions to hold the keeper liable, and as such, there is no obligation for me to identify the driver.
If you believe otherwise, I request that you provide a detailed explanation of how the NTK fully complies with POFA, including references to the specific clauses that you believe have been met. - Failure to Notify Users of Autopay Deactivation
The vehicle has been registered on an autopay-enabled account. However, NCP has unilaterally disabled autopay for all users without prior notification. This failure to adequately notify existing customers and update the NCP app to remove the functionality meant it is reasonably expected autopay to function as it has many times previously, and there to be no reason to believe payment had not been taken. - Failure of the Pay Later System to Apply Discount
Upon discovering that no payment had been taken, NCP were contacted via the in-app chat and advice was given to use the “Pay Later” function. However, rather than being charged the expected £9.95 all-day rate with the MANCSAVER discount, the total to pay was £34.95, a significant overcharge. Despite raising this with your customer service, no acceptable resolution has been offered. - Unfair Handling and Preventing a Fair Resolution
A genuine effort was made to resolve this matter by attempting to pay the correct amount. Due to your failure to honour the correct rate, it was not possible to complete payment before the pay later deadline expired. This unfair process has directly resulted in the PCN being issued, despite my willingness as the registered keeper to pay the original £9.95 fee.
Resolution Requested
Given the above points, it is requested that this Parking Charge Notice be cancelled. As a gesture of goodwill, I am willing to pay the £9.95 the driver would have expected to be charged, but will not accept liability for an overinflated penalty fee caused by NCP’s own system failures.
Should you choose to reject this dispute, I request a POPLA code where I will challenge this further.
I look forward to your confirmation of the cancellation of this charge.

Isn't it meant to be a complaint not an appeal/dispute?
Point 1 should be removed. POFA compliance isn't mandatory and clouds the complaint.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
