he had disappeared and cms cant find him either. He has instructed a solicitor for a forced house sale and expects me to pay his legal fees.

Provide CMS with his solicitor's details. Ignore the threats.

As others have said, speak to a solicitor. It's a catch 22 at the council, because they won't prioritize you for housing until you are facing homelessness, but you won't be facing homelessness until you have a buyer for the house.
Until you get the ball rolling on the sale they will probably see you as adequately housed.

I was thinking about how the shares work if guys daughter needs the house. It's not uncommon in married couples that split that the parent with the responsibility for the kids gets to stay in the house until the kids are grown. A solicitor could advise, but rest assured he can't sell it from under you as you need to sign to agree.

Parents hate me, its bought out right this house no mortgage, ex partner not married
In which case you will be forced to sell, and the longer you fight this, the more it will cost you.

What is the property worth? You'll be entitled to your percentage share.

Any appeal will just highlight that when it sells you will have money to find a solution.

Just put it on the market (all selling costs should be split as per your percentage) then when you have a buyer (or before) you can contact the council to ask for help.

His parents are entitled to their money back.

Life is harsh sometimes but you need to move forward. Do you get financial support from your son's dad? Could he help you out?
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
