Section 137 Wilful obstruction of highway


Hi all
Can someone please help me. I've just received a pcn from the council yesterday (13.03.25) for something that happened on 09.10.24.
I have been stopping here 2 or 3 times a week for past 5 years or so as do 100s as there are a parade of shops and takeaways. max I usually stay for is 5mins as I usually order food ahead.
yesterday the council itself sent me this fpn and say they will also fine for every other time if I've parked here.
There are no signs to say no parking or stopping. There is a bike lane but i parked so that there is plenty space for cyclists left
Is there anything I can say to get it cancelled? For what it's worth I usually have my son with me who's autistic and a blue badge holder. my wife was also in the car and had the key should anyoen needed us to move ( not they they would as theres ample space for both cyclist and padestrians)Comments

We don't cover council tickets here only private parking companies.
I suspect the council have you bang to rights parking in a cycle path with photos. A disabled badge doesn't allow carte blanc parking anywhere

So you were caught by the ANPR camera I have circled here, and by your description parked on the pavement.If so you have been lucky in the past, definitely chancing your arm, no dropped curb so even driving over it is illegal, parking on the pavement in London is illegal and you are obstructing pedestrians.They must have evidenced the photos taken.As for retrospectively fining you that's probably just a threat to get you to accept and pay up this one.I still suggest you take this to https://www.ftla.uk/ but don't hold your hopes up, they will need more evidence than you have so far provided too.
