Completing and no responses

Hi,

we are trying to complete on a new build property. Throughout the process the developer has been extremely slow. We are now at a point where all we need is them to send an updated epc so we can complete. This has not happened for 3 weeks and now they are ignoring emails and calls. 

We think this will stop us completing before the 31st of March so will incur thousands of pounds in stamp duty due to the increase.

is there anything we can do. We are at our wits end.

    Why do you need an updated EPC? Are you saying there was already one issued but there's a problem with it?

    Are you sure it's not a building control completion certificate or a certificate for the house building warranty that has been delayed?

    Check any such certificates carefully.

    If you have exchanged, then your solicitor needs to send a notice to complete.

    Have you checked the EPC register to see if they have done it but just haven't sent it to you?

    Developers will wish to complete as soon as they are able. Without hearing their side of the story. No amount of chasing is going to speed matters up. Often when being bombarded with contact. There is no response as there's nothing to say. Not a productive use of work time.

    An updated EPC on a newbuild? Usually the Predicted Energy Assessment (PEA) is relied-on until after completion. Once the (ie NHBC) cover note is issued, ten days notice to complete is served on your solicitor by the developer's solicitor.

    Which will be laughed at.

    It's the builder through their solicitor who serves the notice to complete on the buyer. The buyer is in no position to tell the builder they need to have the property built by x date.

    An updated EPC? I thought they lasted 10 years, and you're buying a new build..... Something's got lost in translation here.
