Probate

Hi, my mother in law passed away and in her will has left everything to her son. The house is valued at £450k. Bank account at £130k. My father in law passed away in 2011 and left everything to my mother in law. If I'm correct there is no inheritance tax to pay. She'll be able to use her deceased husband's nil rate alongside her £325 plus £175 as the property is being left to her son. Do we only need to fill in PA19 and tick the relevant boxes about transferring unused rate or do we also need to fill in the IHT 400 along with the schedules to therefore transfer the unused rate? I've been given different advice from both the probate helpline and the tax people. The tax people just say fill in the on line checker and it will say if I need to fill in the 400. I did and it doesn't but the probate helpline said I did. Would appreciate clarification if you could help. Is it just PA19 or do I need to do the schedules as well for transferring unused rate. Thank you in anticipation.

    As the estate is bellow £650k you have no need to claim her residential NRB (which would require a full IHT return) so you just need to apply for probate. 

    This can be done online which is likely to be quicker than doing a paper application. You will be asked if you wish to claim the transferable NRB during the application process.

    Thank you. I'll do the PA1P only. I'll do on-line too.  The annoying thing is, after the probate helpline said do the IHT 400 form and the relevant schedules, I spent ages on it.  Oh well, it kept me busy ha ha.  Thank you for the clarification.

    Update. I submitted on line and the grant of probate came through 7 days later. Thanks for the advice.
