That's the point I've been making, they're not allowed to strip customers of their rights, so your rights are primarily defined by legislation! Ts & Cs can and do operate alongside such statutory rights but can't override them.mlody said:it's disgusting that a big brand like that is allowed to strip the customers off their rights simply by writing stuff up in their terms and conditions.
And in terms of 'a big brand', bear in mind that you're not dealing with Debenhams as you'd have known them on the high street, but online retailer Boohoo, who acquired the trading name when the old company went under....3 -

Writing from a company standpoint, the 2019 case with the German company is interesting. It is worth noting that the courts also decided that the customer is liable for the diminished value of the mattress so the customer may have only got back a small % of what they paid.
