DCB Legal Claim Issued 15 February. Judgement entered against me yesterday

Options
Hello. Please could someone provide me with some guidance.
DCB Legal sent me a claim that was issued on 13th Feb. I was not at my flat until this morning. I attempted to follow the guidance on here to do something called an acknowledgement of service. I was advised on the money claim online page that a Judgement has been entered against me. Can someone help me to understand what is the best thing to do now please? Will there be a CCJ against me now? Thanks very much in advance.

Upon receipt of a N1SDT claim form, there is a limited time to submit the AoS; clearly you missed it.  Therefore you presumably also missed the time for submitting a defence, which means the claimant was able to "press a button" for an automatic judgment in default.  Two options now, pay up in full before the cut-off date, normally 30 days (but I have seen less) OR apply for set-aside using a N244 form, which will cost you £303 with no guarantee of getting it back.  You need a REALLY good reason (not excuse) why you failed to answer the claim; judges don't like credit cleansing.  One possible reason is that the claim was sent to an incorrect address.
  • Thank you Le_Kirk. I appreciate your help. I will process that and make a decision on what route to go down. The car in question, a 15 year old Fiesta, had been in my name 2 years ago, but I never passed my test, I never went back home after uni, and had no need for a car, so the ownership was transferred to my grandad, who had the car at the time of the alleged parking contravention.

Your only hope is to be able to evidence why you were not able to receive the claim form and acknowledge or defend it. For example, if you were abroad and can show tickets or boarding passes in your name that you were out of the country, that is a valid reason to apply for a set aside of the judgment.

If you cannot evidence why you were unable to respond to the claim in time, them you have to decide whether it is worth trying to get it set aside or just paying it within 30 days of judgment and avoiding a CCJ on your credit file for the next 6 years.
