Small Claims Track Hearing DCB Legal/Euro car Parks

Hello all

I've been viewing this forum for the past year, haven't needed to post until now as I've been following the advice in the Newbies thread correctly. (Appeal, AOS MCOL, Defence, court mediation, Directions Questionnaire ect). During the whole time I've ignored private calls from DCB Legal and now I've just received the notice of allocation to small claims track hearing, which means I've been summoned to court. In the one post of this thread and I'm crossing my fingers it's true.

'DCB LEGAL RECORD OF PRIVATE PARKING COURT CLAIM DISCONTINUATIONS'.

Obviously I can't post any personal details of the date because it's in the next few months of location, but any questions to ask me to help me ease my worries and to help megive more correct details please ask and reply with some positive knowledge to help ease my worries.

Also if this does go to court, and they do pull out, will I be refunded my court fee?

    Update: sorry I see now it is the claimant who has to submit the court fees and if they do not then the court case is dismissed. Still this deadline is looming, could you guys provide me some reassurance, some links to perhaps to help me feel settled?

    Just follow the advice given in the following threads

    Newbies sticky thread in announcements 
    The 12 steps in the defence template thread in announcements 

    The discontinuations thread by Umkomaas with nearly 500 examples,  yours will probably end up there too, near the trial fee date   ( you dont pay it, dcb legal do ,  or don't   )

    Study the ongoing cases that are in front of yours,  they all follow a similar pattern,  so I doubt that your case will get to an actual courtroom 

    Take a chill pill, use the time to work up a draft witness statement bundle,  including exhibits

    Sign up to Courtserve and then you can see the daily Euro Car Parks cases. You can also see which courts tend to hear the claims. 

    Usually about 5 a day. 4 of those are usually set asides where someone forgot to defend, and the fifth is usually where someone has asked for it to be judged on the papers (not usually recommended).

    The odd one that goes to a hearing are likely to be multiple tickets where there might be so profit in it.

    You haven't got a summons. It's just a hearing and it won't happen.

    Be confident!

    DCB Legal will phone you, give up then discontinue this Spring.
