Paid for parking at wrong car park - received letter from BW legal this week

Hi all

First of all, I have looked through all the useful information that the forum moderators have directed me to but in all honesty I have found it a little overwhelming and I just wanted to type out my individual situation and hope you can help me on the steps I need to follow please. 

I parked at a private car park that had 3 car parks on one street. I paid by app for NCP as i thought this was the correct car park. Turns out it wasn't and this week I have received the usual threatening letter from BW legal asking for £170 or court action. The date I parked was the 21st October 2024.To make matters worse The PCN did not reach me as I haven't updated my log book so have passed to the debt collectors who found my address. Of course I have lost my chance to appeal now. I will of course update my log book urgently.

I know the advice is do not call them until told i must go to court but this doesn't sit with me well. I am concerned about my credit rating but also I am not wanting to pay this money so I'm conflicted.

Please can someone advise and give me confidence that I can win this as I've been waivering today on just paying - pathetic I know and doesn't help.

    Thank you. No it isn't a LBC yet (it says that will come next). It's basically a letter asking me to pay 170 pounds from BW legal saying if I don't before the 31st of March 2025 "further collection activity will continue".  It's also offering a payment plan and telling me that to avoid court proceedings pay up basically

    But you WANT the court claim. That's when you win and the case is over.

    No worries.

    Once it is at £170 you're at stupid disproportionate rip-off level, so there's literally no point in any victim of any PPC engaging whatsoever, except:

    -  to erase any old address or

    -  to reply to a LBC to look reasonable later.

    Bring on the claim.

    As well as advising DVLA of your correct address, you must send an email to the DPO of the parking company advising them of your correct address for service, requiring them to advise all and any of their agents and sub-contractors of same and to ERASE your old address.  You don't want the possibility of them sending a N1SDT claim form to the wrong address.

    Is there a template for this letter? My driving license has my current address on - do I need to contact them again?

    So your driving licence does but does your V5C? Update if not as details on V5C are what DVLA gives to parking company but PPCs can only ask DVLA once for each incident. Debt Agencies aren't allowed to ask DVLA for your address they find you by doing credit traces.
    Your looking to send a Data Rectification Notice to the DPO. This thread may help or search google. Attach proof non photo ID like redacted bill/statement.

    Driving licence is irrelevant (apart from making sure DVLA has correct address, which it seems it does) it is the V5C that MUST have the correct address as that is where PPCs get your correct address; as for a template, you could use my words (suitable edited) topped and tailed with Dear Sir ..... yours faithfully.
