Refund of Finance Payments

Hi guys,
looking for some help with my car finance that I’ve had a very bad experience with. I bought my car on a finance agreement back in 2023 and at the start of 2024 it had to go back to the garage due to various problems ( Still under the extended warranty). The garage very kindly provided me with a courtesy car while the ‘attempted’ to fix my car. However, after months of no communication and I contacted the garage to be advised the car was a write off and there was no way to get this car back. The garage offered to provide me with a new car around the same price to keep my outgoings the same. Upon months of waiting for the garage to contact me with a new car, I ended up chasing them again but was getting nowhere. At this point, I contacted the ombudsman to get things moving. While all of this was going on, I was still paying my monthly finance.
Eventually the garage came back with a newer car which would result in me paying around £30 more a month on finance. I went down to look at the car and was quite keen on taking this car until we spoke about the finance agreement. The garage told me that the monthly payments I made over the year (Close to £5000) of me not having the car would not be reimbursed or added onto the new car or finance agreement which would restart on a brand new 5 year agreement.

I told them I was not happy with this agreement and was told they could not do any better. I contacted the ombudsman again who took several days to respond and making promises to contact me and never did. When he did eventually call me, he told me to take the deal and said I should be grateful as the dealership offered to take £1000 off the new finance.
I don’t think it’s fair for me to lose close to £5000 and be put into a new 5 year finance agreement for the year of waiting and hassle I’ve had

What was wrong with the car? Age of car, mileage etc?
When did it go back?
When was it written off?
FOS would not be interested till you exhausted finance companies complaint process. Even if complaint went to FOS, you are looking at months before getting a reply, as they will be looking at cases in order.Life in the slow lane0 -
Are you sure you've "lost" £5,000? You were paying a monthly fee for the use of the car and while it was out of action, it sounds like you've had the use of an equivalent vehicle. That £5,000 would have been paid whether your car had had problems or not. You've also been offered a £1,000 discount off the new deal.
But without knowing more information such as that asked above, it's difficult to say.0 -

It was back and forth until the garage fully took it back in April.
Problems with the car was Seatbelts, Air Bags and Engine faults which they couldn’t work out until they had it back in September and declared it a ‘write off’ after a week
Car had 70,000 miles and was a 68 plate
