Horizon Tescos POFA compliant PCN?

Hi everyone, advice needed please on our next steps..

My daughter who is a relatively new driver received a PCN from Horizon a couple of days ago as she is the keeper of the vehicle in question but wasn’t the driver at the time. Understandably she wants the fine/charge paid so it goes away. 😒

The notice was issued on 20th Feb 2025 & date of breach was 13th Feb 2025 for exceeding the maximum stay at Tescos. 
We (I) have tried complaining to the Tesco manager in store but to no avail. So what is plan B now? Looks like she has been issued with the updated POFA compliant Ntk, does that mean they do have keeper liability if she appeals? So do we or don’t we appeal? Or are we waiting now until we get a court claim? Any advice welcome!

    "inform the driver that the parking charges relating to the specified period of parking have not been paid in full and specify the total amount of the unpaid parking charges relating to that period"

    I don't think it is compliant. The period of parking is there, but the specified period for the alleged breach is absent as there is no indication what the maximum stay period is. 

    The maximum stay period might have been exceeded by seconds for you know, especially as they have the time period clock to that unit. That fetters your ability to appeal.

    You could try "appealing" and they'll tell you the time period. But you'd have to argue at POPLA the notice is non-compliant, so them telling you the exceeded period after the event is of no use.

    I'd ignore it, if you can't get a nice person at Tesco to cancel it.

    Come back if they try a small claim because that's when cases are won (discontinued by DCB Legal).

    There's no risk and you wouldn't pay a phishing emailer to 'make them go away'

    As long as she doesn't move house and not tell them the new address - which is, of course, vital - defending a claim is EASIER than appealing.

    I'd be having another go at Tesco and asking them if they really want to lose the custom of your daughter, yourself, all your family and all your daughter's and your friends!

    Where is the invitation to the keeper to pay as required by POFA Paragraph 9(2)(e) ?

    She’s 19 & ever since passing she’s been a very careful driver. She’s pretty miffed off that she’s got this ‘fine’ as she puts it, especially when she was not the driver. I’ve assured her to trust the process on this but will try Tesco again & if unsuccessful will ignore & wait for claim.

    Good!  It's an important life lesson NOT to pay scams to make them go away.
