    UPDATE:

    So I called the CNBC last week to ask for an update as it's been more than 6 weeks since I submitted my DQ (for the 2nd time) without hearing anything from them.

    The rep on the phone said there is no record of my DQ being submitted and that therefore my defence has been struck off!

    I politely told her that I submitted my DQ not once but twice, upon which she provided me with a different email address and advised me to send evidence/screenshots proving that I received the automated reply from the DQ email for the 2 times I sent it. She also said I should send this same email, separately ,with the evidence to the original DQ email.


    Before I go ahead and respond to them with the evidence, I wanted to post about it here to see, is this normal?? This is a genuine hassle they are putting me through that I can definitely do without at the moment.

    URGENT UPDATE:

    Please someone help me!

    After having followed all the steps in submitting the DQ and the court telling me multiple times they haven't received it, I eventually got it escalated and had someone from the court reach out to me to request further evidence. As you can see in the screenshot below, they emailed me on the 8th of August to request the further evidence. I replied on the 12th, once again uploading the DQ and as usual received the automated reply - but clearly they have once again not received it.

    They mentioned in earlier correspondence to me that the email must not exceed 10mb as it would automatically be deleted on their end. I double and triple checked this and made sure the email size was under 10mb. 9.8mb to be exact.
    I now suspect the email size is still the issue, as they did receive all my correspondence when there was no files attached during previous back and forth emails.

    As below, it seems they've now permanently struck out the defence.I cannot see anything that makes me non compliant with the court's guidance and certainly dont' want to pay and go through the hassle of having to get the defence reinstated, as they are instructing.

    Please, if anyone can help me with this I would so greatly appreciate it!

    there is no way a PDF file should be over 10mb!

    It wasn't a PDF file. It was images of a physical DQ filled in with a pen.

    Having said that, I'd really appreciate a helpful way forward...

    When people download the N180,  fill it in and email it as a pdf attachment,  it's definitely under the attachment limit 

    One person here who had similar experiences as you had emailed jpeg pictures of the paper form, instead of a pdf. Another had scanned the paper N180,  and attached a file, both resulted in similar problems

    The usual advice is to escalate the complaint and to complain to hmcts too, in writing,  usually by email,  with proof

    When I saw that thread last week, I sent a query to CNBC to ask about jpg/jpegs but as of now, no news.  It is no good CNBC (or any company) telling senders they can't use a particular file format or over/under a certain file size AFTER the event; best to have this information up-front.

    The court's email guidance (Practice Direction 5B) does specify the 10mb limit but makes no mention at all about file type other than:

    "3.5 Attachments must be sent in a format supported by the software used by the court office to which it is sent. The format or formats which may be used in sending attachments to a particular court office are listed in the e-mail guidance."

    I'm not sure what email guidance they are referring to but I have yet to find anywhere saying they don't accept JPG files.

    As such, I am quite furious that I'm now having to submit a complaint about this - one I am not too hopeful will be resolved, which would mean I have to pay a hefty fee to submit the N244 form. I'd be cheaper off just settling the claim being made by Parking Eye, which makes it pointless getting the defence reinstated for that fee.

    Our experience us that anything other than a pdf or paper seems to cause this issue,  or it's the file formats or sizes

    There is another similar one posted today,  where the paperwork was scanned , submitted in June, not logged , so sanctions imposed this month

    No it doesn't. No form is used.

    You email a formal complaint to the CNBC and a tandem complaint to HMCTS. Saying that your N180 was sent and acknowledged and did not exceed 10mb (attach proof).  ALSO ATTACH A PDF VERSION NOW, TO HELP THEM DO THE RIGHT THING.

    No application. No fee.

    HMCTS normally reply to complaints about the CNBC fast and well.
