Erroneous Parking Charge - Group Nexus - Scotland

Hello,

I have read the newbies thread, and will see about complaining to the retail operator / use the template, but can I first check what peoples opinions are on this:

I visited Kinross Service Station in January and parked for approx 20 minutes to pick up some food.  I then left and drove to work.   Later that night after work, I needed to top up my fuel so I visited the adjacent Petrol Station, fuelled up and left for home, exit was through the service station car park, I was at the petrol pump for about 5 minutes, I did not use the car park during this visit, but the exit was through the car park

A few days later, Group Nexus mailed me a parking charge claiming I parked there for nearly 5 hrs, along with some muddy photos of my registration plate.  Clearly, they have used the entrance time photograph from my 1st visit and taken the exit photograph from my fuel stop later on.

Obviously this being a mistake, I will not pay - but what is the correct course of action here?

    Yep, bound to happen. Not a 'mistake' as such. They know their cameras are set up for this:

    Thanks to the rogue ANPR-wielding parking industry, drivers can't visit the same site twice in 24 hours. Shocking, innit? They are meant to do checks to avoid 'double dips' but they don't and this is a data protection breach as well as a breach of the Code of Practice.

    Put in a COMPLAINT (not appeal).

    (normally we'd say ignore private PCNs on Scotland of course. Hope you realised that?).

    Regarding your last comment. Your signature says: "PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland)." but you advise to ignore private PCNs in Scotland - can you clarify which advise to follow and if there is a distinction. I am searching the forum but it is hard to distill into solid rules of approaching in Scotland.

    At the moment the standard advice is to ignore private parking company charges in Scotland,  due to no current liability by a keeper in Scotland.  That will change for Scotland this year if the 3 government's finish what they started years ago,  but hasn't yet 

    The only clear distinction is a clear and obvious error like double dipping, definitely not your vehicle in the pictures, ANPR  misread etc 

    Never,  never blab about or infer who was driving the vehicle 

    So in your case, complain as the recipient keeper about their clear and obvious error,  like  Var on their ANPR error 

    This is a well known, well publicised ANPR camera error all over the UK,  I found out about it around 12 years ago
