UC partner owns half of his moms house

A long time ago my partners parents signed half of their house over to him, his mom is a pensioner and still lives there. We gain no income from this.
Does this count as capital for UC? 
If so is it included in the capital disregard for moving from tax credits?

    Is it held in trust until his mum dies? (did dad die and leave their half in trust to their son?)
    Is he free to sell the house to realise his share of the capital?
    How is the property held with his mother - tenants in common or joint tenants?
    Yes, he will need to declare it to UC and yes it can be disregarded as part of transitional protection when moving from tax credits.
    UC will need to decide if it can be disregarded for longer, or only for 12 months under transitional protection when migrating to UC from Tax Credits.

  • @NedS I have just found the regs saying it is indefinitely disregarded as capital because his mom lives there and is over pension age.

    Great, so he can declare it and a Decision Maker will make the decision to disregard indefinitely (or until mum passes)
