I have today received a letter from HM Courts & Tribunals Services I will attach documents if anyone and give me advice on what to do next please I will be very grateful , here is my response.   I admit that I was parked in the disabled parking bay at the said retail park but I thought I had put my Blue Badge in the window of my Disability vehicle, Due to my disability's I have trouble walking no more than 20 metres either aided or unaided , My medical Diagnoses are COPD, Asthma. Bronchiectasis, ischaemic heart disease, unstable angina, TIA's in the 4 mins it took someone to take pictures of my disability vehicle I was not able to get back to my car to double check that my badge was in there, someone else that was shopping told me that a man had been taking pictures of my vehicle, and than I got a PCN through the post, I have attached a pic of my Blue Badge if you require a list of my medical condition's from my GP and all the medication l'm on I will gladly provide them, I would be very grateful if you could see your way in cancelling this PCN for me as it was a genuine mistake thank you.

  I think you are being extremely unfair , this has caused a lot more stress to my health mentally and physically its also made me anxious when I go out. My BP has gone through the roof my heart palpations have grown worse my GP has prescribed more meds, all for the 4 mins it took some man to take pictures of my Disability vehicle, I have sent you proof that l'm registered disabled which you all ready knew after contacting DVLA for my contact details, I have already admitted it was a genuine mistake but you still persist, I have explained I have difficulty walking. and couldn't get back to car in time I have already explained this in previous correspondence. The Equality Act 2OI0 means you must be treaded with understanding and can't be discriminated against so the ticket should be cancelled due to being disabled and having trouble walking. I hope this satisfies you and you see your way to ending this distressful time for me thank you

and then I get this reply   The Appellant claims that they had a valid blue badge and provides one side of a badge as evidence to support the claims. There is nothing to show the badge relates to them, or any evidence of the underlying conditions, which they also seek to rely on. As explained above, at this stage, the onus is on the Appellant to satisfy me the charge is unlawful. ln the absence of any evidence, I am not satisfied.  Am I right in thinking that Proof of a BB you can send a scanned copy of your badge or just badge serial No which I did . I'm sorry its along drawn out post but i don't know where to turn next

    Sorry, I didn't read that slab of text you have thrown at us but did notice that you have left your MCOL password clearly visible on that image.

    With a Claim Issue Date of 25th February, you have until Monday 17th March to file an Acknowledgment of Service('AOS').  Do not file an AOS before 1st March, but otherwise there is nothing to be gained by delaying it. 
    To file an AOS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an AOS in a timely manner, you have until 4pm on Monday 31st March 2025 to file a Defence.
    That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the AOS guidance.
    Don't miss the deadline for filing an AOS, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an AOS has been filed, the MCOL website should be treated as 'read only'.

    I get what they are saying. The OP appealed to the IAS and this was the laughable decision:

    More proof that the IAS isn't fit for purpose.

    In most current defences v DCB Legal claims, paragraph 3 (within the 30 paragraph Template Defence) looks similar to the thread below by @shahib_02  ... just change the incident date:

    No need for more detail except in your case just add an extra paragraph to the Template Defence:

    3.1. Talk about the appeals you made attaching your Blue Badge but the non-impartial 'Adjudicator' flatly refused to consider it. However, the Equality Act 2010 applies and the Claimant indisputably knew that the Defendant had multiple disabilities and saw the Blue Badge at two points during what the Defendant now understands is a farce of a pseudo 'appeals service'. By not cancelling the PCN, they have failed in their legal duty to make 'reasonable adjustments'. The charge is illegal under the EA.

    Good afternoon all, Just a little update after all the toing and throwing since Feb and sending off my Blue badge details and all my medical history a few times to dcbl and CNBC. I have now received this email today from dcblegal acting on behalf of Excel Parking. I would be very gratefully on my next step do I pay or send in a counter offer, thank you

    Upon review of your file with our Client, they acknowledge your medical circumstances and due to this are open to settling this matter. Our Client would be agreeable to £184.00 in full and final settlement of this Claim. The current outstanding balance is £261.52.

    Update I have now been issued a CCj  against me the sum has jumped up to £292.15. I only become aware of this after receiving a Judgment for claimant ( in default ) dated 30/06/2025 is there anything I can do now or just wipe my mouth and pay it. any help greatly appreciated
