    Yes, read the mediation advice in the newbies sticky thread in announcements near the top of the forum by coupon mad,  plus the 12 steps you should be following in the defence template thread   ( step 9  )

    Plus read the recent feedback reports from other victims too

    Most victims either offer £0, or maybe £10 , or refuse to offer anything so no compromise and no resolution

    Case Lost ! - Claimant awarded £217 in charges.

    I was given notice of the hearing less than 2 weeks before for the hearing, so i did not have enough time to submit my evidence., not that it would have counted.

    The case was heard by video and the claimant chose not to be present but rely on their evidence and witness statement prepared by a paralegal.

    The claimant submitted pictures on the car park and signage, with timestamps showing my entering and leaving. A total of 13min.

    The judge stated he is satisfied by the signage and that by parking on the lot I had infact entered into a contract.

    If anything this is a costly but educational experience.

    Sad to hear but this almost always happens when people don't file and serve a WS and evidence, I am afraid.

    The judge had no other submission to go on and you were heading for a loss, unless their pics and argument were awful. You should have filed & served a WS anyway when you heard about this hearing. If you'd come here we'd have helped and given you a shot.

    As it was, you had no voice as a witness and no evidence. It is rare to lose when the other side doesn't show up but you gave your judge no choice.

    Did your judge not listen when you raised Chan and Akande? You know, the first point in any Moorside defence (surely that point was added into your defence, as you were given the transcripts to those cases a year ago, just in time for you to add them).

    With a fair judge, you could - potentially - have won on those authorities alone, if you'd done a WS or skeleton argument last week, showing the judge those transcripts.

    But no point crying over spilt milk.

    Chalk this one down to experience and if there is ever a next time, ask us for help at every stage, especially if a hearing is sprung on you.

    I dont want my loss to put anyone else off. Given the length of time that passed between preparing for the case and the actual hearing date that was sprung upon me, I failed to prepare adequately and accept full responsibility. I gave the judge no other option. I suspect that harsh decision was based on my lack of preparation. In all fairness to the judge He did offer me the opportunity to adjourn the case so i would have time to prepare my witness staetment which i declined and chose to go with the Defense statement. The weight of the entire ordeal took its toll on me and i just wanted it over.

    This is a tough lesson but one I am glad to have experienced. I chalk it down to lack of experience and naivety.
