    Hi everyone, 

    I’ve received this letter today and would be grateful if someone could help me understand it. 

    I’ve emailed my defence to CNBC following all the steps and received the email acknowledging it too. 

    Is there any chance they still haven’t received it?

    I appreciate your help again! After one and a half hours reading different threads and complaints, this is what I came up with: 

    Dear Sir/Madam,

    I am writing to formally complain about the improper Default Judgment entered against me on 6 May 2025 regarding the claim xxxxxx. I received the letter of this judgment today by post. Please be advised that this judgment is erroneous and must be set aside without delay under CPR 13.3.

    Timely Filing of Acknowledgement of Service and Defence

    ·       Acknowledgement of Service was submitted on 28 February 2025 (received 3 March 2025).

    ·       A complete Defence was filed on xx March 2025 at xx via ClaimResponses.CNBC@justice.gov.uk—well before the deadline.

    I have documented proof that your office received both documents before the relevant deadlines (attached). This constitutes a serious procedural error since my Defence was submitted and acknowledged before the judgment was entered.  

    Demand for Relief

    1.    The immediate setting aside of the Default Judgment by the Civil Procedure Rules.

    2.    Written confirmation that no enforcement action will proceed while this matter is under review.

    3.    Escalating this incident within your management structure and reviewing your procedures to prevent similarly unfounded and predatory claims against vulnerable individuals.

      

    It is unacceptable that judgment was entered in default when the court possessed my validly filed Defence. I demand that this improper judgment be set aside immediately and without cost to me, as it was clearly entered in error. Furthermore, I request confirmation that this matter has been rectified without requiring me to make an unnecessary and costly formal application.  

    If this request is not fully honoured within seven days of the date of this email, I will have no alternative but to raise a formal complaint with my Member of Parliament, the Ministry of Justice, and the Civil Justice Council, and to consider all other remedies available to me to protect my rights.

    I hope you will treat this matter with the seriousness it deserves, and I look forward to your quick confirmation.

    I'm fuming! Nine days have passed since I emailed them, and I've still not received a response. I've checked the MCOL account; it hasn't changed, but the judgment has already appeared on my credit score 😩
    I am currently 20th in a phone queue to speak to them. The web chat that they highly recommend is just a bot that tells you that 'you are being connected' for the past 15 minutes.

    Hi all, 

    I felt like giving you an update may help other people with similar case-related issues, such as the judgment wrongly entered against them (even though the court has a valid defence).

    Timescale:
    Defence submitted - 18 March
    Default Judgment entered against me - 6 May
    1st email complaint sent - 10 May
    Phone call to CNBC - 19 May
    2nd email complaint sent - 30 May
    Judgment set aside - 3 June 

    The CCJ was removed from my credit score after about 1.5 weeks. I didn't have to do anything from my end.
