Loan/Hire Car PPC - What to do first?

Hello Everyone,

Wonder if I can ask your guidance please?

I was driving a Loan car given to me by a garage whilst they fixed my car, and was issued a PPC from NSGL (photo attached below).

The garage contacted me by text, attaching the same photo below, and asked me to deal with it. Note that it’s addressed to the Company Secretary and further down requesting they identify the driver.

First of all, do I sit tight and wait for the garage to identify me, or do I proactively contact NSGL so they can begin pursuing me.

Secondly, is it possible to begin the appeals process without identifying myself as the driver (which I understand is the advice given on this forum). In other words, can I admit I was the Hirer of the vehicle without admitting to being the Driver. I guess I’m talking semantics here (Hirer/Owner/Keeper/Driver) and how importantly it is to use the correct word in this situation

Just in case it’s important: the situation here is an apartment complex with limited parking, leaving residents no option but to park “illegally”. Parking infractions are recorded by a guy walking round the grounds with a tablet (I’ve seen him from my apartment!). No window stickers, no ANPR…just a letter in the post several days later.

Cheers,
A

Please show the back because that NTK has been posted too late for the recipient keeper (the company) to be held liable.

Tell them to transfer liability to you by filling in the slip on the back.

Hopefully my reply to this thread will push it to the top because it has taken an interesting turn!

I took the advice of Coupon-Mad, phoned them up and requested transfer of liability. Provided the necessary information (Name & Postal Address) and expected to begin receiving letters from NSGL so I could appeal the PPC. Several weeks passed however before receiving a letter in the post from the company telling me they paid the PPC and instructing me to reimburse £80. In the correspondence were copies of the initial PPC, subsequent NTK, and also the ‘Final Reminder’…and also proof of payment to NSGL.

The company is an independent car garage but will be considerably richer than me so what are the risks of them taking me to court for failure to pay an outstanding invoice and is there anything I can do to arm myself? I’m kicking myself for not emailing them requesting to transfer liability; but I do have the 3-minute call log history on my phone

That was not what I advised. I didn't say ring anyone and I didn't say you could do it (you couldn't, not even by email). Had to be done by the keeper.

The company simply had to fill in the slip to transfer liability. No wonder it went wrong. That isn't how to transfer liability. The keeper merely had to be told to please transfer liability. Then you'd have got a NTH.

It's up to you whether you reimburse the company or not. I would never have advised you to ring or email.

Apologies…I think the way I described it wasn’t clear. I contacted the Company to ask them to transfer liability. Did you think I phoned NSGL?

    Yes! It read that way.

OK so you should refuse to reimburse the company because you instructed them to transfer liability to you ... and they didn't.
