So to update the appeal was unsuccessful, do you want me to copy the assessment/decision here?0
-
In the POPLA Decisions sticky thread please, but only if you add ten paragraph breaks and not just copy & paste POPLA's wall of text!
We all knew you'd probably 'lose' - as we told you. Doesn't matter. Shouldn't have bothered but I do recommend you download and keep the evidence pack this week otherwise you can't access it later.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Good afternoon,
I have now received a claim form for this and since my last post I have moved out of the address on the form. On the MCOL enrolment I'm assuming I put my new address rather than the one on the form, is there any other actions I should be taking in regards to this discrepancy?0 -
I believe you can make that change at AoS stage but you should also send a data rectification notice to the DPO of the PPC and you can also email address changes to CaseProgression.CNBC@justice.gov.uk

Definitely do it both on the AOS and by emailing the Claim Responses email separately, and cc in the solicitors.
You cannot have this old address on file and really should have updated the solicitors before the claim, to avoid the real and extreme CCJ danger of missing paperwork if the CNBC get it wrong.

When I emailed group nexus earlier today I added in the following:
I request that you update your records with my correct address for service, as detailed above, and ERASE all other address data that you hold for me, and inform any and all of your agents and sub-contractors to do the same.
Will that be enough to reach DCB Legal?
I'll email the case progression now with the address.1 -
No that isn't enough. Won't reach DCB Legal. Do exactly what I said.

So I've sent the emails and since then CP plus have sent another letter with legal action pending.
For paragraph 2 am I now admitting that I was driving?
Also for paragraph 3 how much information is too much? I don't want to risk shooting myself in the foot.
I feel like the only suggestions that are relevant to my case are them refusing my appeal and not seeing any signs.
I was falling asleep cause of fatigue so i was never looking for signs only the nearest parking space to rest. It was late night at the start of winter so it was pitch black by this point.
I have back and forth emails with moto about the situation and they were less than helpful, would that be something to add to defence?
Last thing to note I found a news article with a CP plus spokesperson commenting on a situation the same as mine would that help my defence?

But why are you trying to draft anything? Surely this is a claim without the breach specified, as per almost all CP Plus claims via DCB Legal.

I'll post a redacted picture of the claim for when I finish work. In the PoC I'm sure it says an overstay on private land or something of the like.
