Morning all. For anyone interested, i've just had my mediation call. DCB Legal reduced the money they wanted off me twice but still want just shy of £100 off me. I refused flatly. As a reminder, my case is based entirely on the fact that their app didn't recognise their location as their equipment was only installed the previous day. Therefore, because their system wasn't operational, I couldn't pay. They countered that in light of that, I should have parked somewhere else. The Car Park in question is at my Doctors surgery. I wasn't going shopping so did not have a choice of multiple other Car Parks. The fact they have offered that argument, tells me they are aware their system wasn't functional. The mediator reminded me of potential additional costs at court etc. if I were to lose the case. Fingers crossed I won't. Thanks for all the continued support.

And with that, the Mediator lied.

People who lose, risk paying £212 all told, unless you get a hopeless judge, or you fail to attend. As the NEWBIES thread tells you, it's far less than the Claimed sum!

Update - Now been given notice of allocation to the small claims track. A load of legal jargon that I don't really understand, but a date for the hearing in July.

Any advice when representing myself would be welcomed.

Yes but obviously having got the Hearing Directions you've read page 2 (the easy instruction to all parties, which isn't in jargon) and which tells you your WS and evidence deadline which is this month.

When is that?

DCB will of course discontinue before their deadline to pay the Hearing Fee.

When is that?

Please don't show us the Order expecting us to read your deadlines (we aren't very happy when people do that!) and while you are reading about DCB's record of discontinuances, please edit your thread title to something more suitable like:

Sorry Coupon-mad, and with the greatest of respect, but I see no reference to terminology such as 'Hearing Directions' or 'WS', within my 'Notice of Allocation to the Small Claims Track (Hearing). I am sure these are bread and butter to you but sadly, mean very little to me. Similarly, I am struggling to understand what your response is telling me.

I'd like to know if I need to do anything prior to the hearing or just turn up and respectfully put my point across as to why this charge is unfair. Thnaks in advance.

If it doesn't give a hearing date yet and doesn't have a page two talking about what 'all parties' are to do and by when, then wait for that.

You need to read post 2 of the NEWBIES thread because no, you do not just turn up, read the section there with the shouty red capitals heading: IMPORTANT; KNOW WHAT HAPPENS WHEN'.

After reading the advice above, and the newbies sticky thread, post 2, and the court order from your local civil court, write down the 3 deadline dates in chronological order, and reply below with them and what they are

1 Hearing fee deadline is. ?

2 Witness Statement deadline is ?

3 Hearing date is ?

Bear in mind that 1 & 2 may be the other way round , but 3 is always last

I have just had an email from a case manager at DBC Legal, acting for the Claimant, informing me that they have been instructed to discontinue Court proceedings and close the file. The attached has also been filed with the Court.

Is that it then? Will I get confirmation from the Courts or can I now relax?
