Parking appeal rejected

Hello, I stopped to make a delivery and got a fine. Appealed it with jopsons case but they still denied it. Is it better to just pay it off or is there another way for me to appeal this.

  • UKCPS don’t earn anything by accepting your appeal. If they take you to court a judge is more likely to understand Jopson v Homeguard as a defence. I suggest you gather any evidence relating to the site including pictures of any signs. Try Plan A and complain to the landowner. Otherwise ignore UKCPS and their debt collectors until you get a letter of claim.

    Relationship with landowner 

    "14.1  Where controlled land is being managed on behalf of a landowner(s), before a parking charge can be issued written confirmation must be obtained by the parking operator from the landowner(s) covering:
    .......
    e) the parking terms and conditions that are to be applied by the parking operator, including as appropriate the duration of free parking permitted, parking tariffs, and specific permissions and exemptions, e.g. for staff, residents or those stopping for short periods such as taxi and minicab drivers, delivery drivers and couriers;"

    Im just wondering how I’d be able to get the contact number of the land owner. It’s literally a road in city centre that has a sign of no parking. 
  • I've just seen off a VCS claim where the signs said 'No Parking'. PCM UK v Bull et al B4GF26K6 was a case I cited for 'No Parking' signs.
  • What does "a restricted area where no parking is prohibited" actually mean, that is gobbledegook!
    But if it was a no parking area there was no offer of any contract so there can be no charge due.

    Just ignore UKCPS.Obviously no paying!

    Search the forum for Moorside UKCPS so you know what not to ignore.

    This is simple.

    Sit tight. Do nothing except the below.

    By going confidently into the 'ignore' stance, the only steps to take (because you MUST check every letter) are:

    - Tell them if you move house within 6 years.

    - Ignore the tedious £170 threatograms shown in pictures in the 4th post of the NEWBIES thread.

    - Come back if you get a solicitor's LBC as per the 2nd post of the NEWBIES thread.

    Nobody pays a penny unless a Judge says so.

    There is no risk AT ALL in defending a court claim. No CCJ. No bailiffs. And - at the time of writing - Smart never sue anyone.
