Executors problem

  • Why isn’t the beneficiary able to do the administration? 

    One option is that the surviving executor could get someone to apply for probate by giving then POA. If this person also happened to be there executor then they would be able to carry on should the executor die before probate is completed.

    next of kin has no actual legal meaning 

    OK so the remaining executor will be wanting to renounce (which they can do ) then someone  will need to apply for administration - this is done by going down a list of people. is there a reason why the beneficiary can't do it - are they aware that they can't progress anything without doing it? 

    If they don't want to do it then another relative can or I think the probate registry will appoint someone

    If the executor of a will dies before completing administration of the esate - the executor of that deceased executor's will is eligible to become the executor of the original estate thrhough the "chain of representation"/

    Rough value of the estate, and information as to whether the deceased was single/ divorced or married/widowed, please?

    Well providing they are not estranged then one of them could take on the role.
