Thanks coupon-mad, I am in the process of wading through the consultation. 

Is it still an option to transfer  driver liability to re start the process back to the original fee. The option to pay at the discounted £40 was not available due to the postal delay in getting the PCN.

Yes the keeper can give the name & address of the driver at any time before court action.
