wondering if i can get some advice .
I received a letter in Dec 24 for a debt that i can’t remember and in my maiden name that i’ve not used for 18 years however i sent Arrow and Capquest a recorded letter to ask them to prove the debt is mine. i later had a reply from capquest only telling me to contact OPOS . I sent a further letter of status barred to Arrow , OPOS and Capquest and had only a reply from capquest with details of who they bought this debt from and nothing else . they ignored the status barred part and again told me to contact OPUS. I sent a further letter but of a complaint to Capquest and stated that they have not responded to the requests i have asked. i’ve had no reply from OPOS or Arrow in regards to other letters i have sent which i sent recorded and kept all evidence .
i have today received a letter from capquest to acknowledge the complaint but also not provided any information on the status barred letter .
I have been debt free now 10 years and this has really worried me. they did offer me a reduced price to pay which was a fraction of the apparent debt but without knowing if this debt was mine i’m reluctant to pay anything at this point.
Thank you

My experience with Capquest was rubbish, they did not reply to letters etc. Next thing i got a letter before action form from their solicitors. Replied back to them and got info i needed, hope it does not come to this for you.I have Dyslexia which is a learning difficulty that primarily affects the skills involved in accurate and fluent word reading and spelling so some post may not make sense.0

i have sent a copy of the status barred letter with the complaint i sent. Can they do a before action letter if this is SB. can i ask what the out come was for you ?0

Hi may case was not status barred, but they did supply the CCA, so arranged a payment with them, no legal action taken.I have Dyslexia which is a learning difficulty that primarily affects the skills involved in accurate and fluent word reading and spelling so some post may not make sense.1

You are one of thousands to have been contacted recently by these firms in relation to highly dubious debts and if you look around you will see many similar threads.
Your case is only unusual in that AGG, Capquest and OPOS all get a mention - usually it's just one or two of them.
The debt is either not yours or so old it's statute barred (barred by statute). They will not be starting a court claim and you can ignore them if you want to. Do NOT do a cca request.
However, they are marking people's credit files so if this is important to you, you should check and, if needed, complain.1 -
If, a claim does come your way, then a statute barred defence is a complete defence to any claim.
Unless that happens, I'd just ignore them, otherwise they cant really go anywhere with this.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Just an update. i received a letter today to say that the complaint raised is taking longer than expected to resolve. still no details on SB and wondered why they would not close the account if there no CCJ or acknowledgement in the last 10plus years. Financial ombudsman is also looking in to the way they have been so i’m unsure if now all of a sudden of having the complaint ignored to now getting letters .
It so so stressful to be getting these letters as i have been debt free , got a mortgage and also my job is now dependent on excellent credit and can’t afford to have an issue over it 😫0 -
Don't be stressed over this. It's only a fraction higher than an outright scam.
They have not even proved it's yours, have they?0 -
No this was the reason for the complaint. i sent them as hybrid SB letter which they ignored then i started getting emails from OPOS so i also sent them the letter i got ignored again. i had a reply from Capquest ignored the letter and told me that they can’t do anything and i need to contact OPOS. put a complaint in with FOS as i felt that they have not provided any details or proved the debt was mine . only after i put this complaint in a received 2 further letters from Capquest but no mention of the SB issue.0

This is how debt purchasing companies tend to work unfortunately, they hold millions of accounts like this, some are assigned to other 3rd party companies to manage, and the sheer volume of post/emails etc they get must be massive.
Its about 60% incompetence, and 40% disregard for your dispute, which is why in your situation we recommend you just get on with your life and let these people go through their "collection activity" and ignore anything that is sent by any of them unless its a court claim.
You can get far too involved in their efforts, when really non of what there are doing actually matters.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
