    Yes you can do that.

Be very careful what you accuse the C of because this isn't a criminal court and you aren't Perry Mason. Don't use words like forgery or fraud. Ask questions and pointedly muse about 'inconsistencies' rather than throwing out accusations, and see what the Judge thinks as you speak.

Look at their body language and visual cues.

    I won!!

It was not an easy ride as the DJ 's starting position was said he did not consider my defence as it was an 'internet defence' which I thought was a bit harsh. The source of a defence should not matter in my opinion as long as it is an accurate defence.

Excel's case was that I had only keyed in 4 alphanumerics and my response was that they had shown no evidence to support this. The judge agreed and because Excel had not shown any evidence as to what they think I had actually keyed in the judge ruled against them and despite their protests said they could not appeal.

I got some costs for time off work and travel too.

I want to thank everybody especially @Coupon-mad and @Gr1pr for their support with this. It was never about the money but all about the principle.

My advice is stick with it but be prepared to put a lot of time in. Luckily I had excellent support from users on this forum and I am so grateful!!

I'm away for the weekend now but if there is any value in me putting my WS up then please let me know and I will upload.

    Thanks again you wonderful people!

    Brilliant!

    ANOTHER ONE BITES THE DUST!

I agree with you that a template defence is fine for consumers to adapt as long as it's relevant, especially v a Claimant that used template letters throughout, a template POC and template WS. It is astonishing that the judge said that. Can he not see it goes both ways?

Anyway, congrats on the win. Exact same reasons as in the hearings with @flowercuppatea and @babtunde345 last week!
