    Email it to the DQ email address as shown in the defence template thread,  no need to post anything,  but do CC the lawyers as well, if they are using a legal company like DCB Legal 

    You add your local civil court and the CNBC are supposed to favour your choice,  not the claimants

    Hi. I have now had a call with the mediator and as the legal firm and I could not reach agreement, I was told by the mediator that this would now progress to court.

    What are the next steps please?

    Do I just wait for the Court to write to me with a date for a hearing? Does anybody know how long this typically takes?

    Yes we do know what happens and how long it might take. 'What happens when' is covered in the second post of the NEWBIES thread under the red capitals heading.

    You should also read some threads linked in Umkomaas' DCB Legal discontinuances thread, any of which will give you confidence and will show you how to write a Witness Statement and the likely timeline from claim form to discontinuance or local court hearing.

    The only thing with yours is it's Excel Parking, who often continue to hearings, so assume it WILL reach a hearing.

    Now I know there is a very good chance I will have to produce a witness statement, is this a reasonable template to use? Clearly I will modify it to match my defence which is that I did actually enter the cark park, buy a ticket and left the car park all under an hour.

    Yep that's the sort of thing but I'd remove a lot of the bottom half which seems to be just repeating the template defence. Don't do that.

    Read up on 'keying errors' and read all the recent faulty machine (keypad errors) publicity against Excel and Euro Car Parks this past 2 months. GOOGLE & read! Use a couple of newspaper articles as evidence. 

    Talk about this appeal and say their faulty machine only recorded the first 4 digits. It wasn't your conduct or mischief that caused the system fault. There was no breach of an obligation by you: 
    I appealed the PCN and provided evidence of a scan of a ticket. Excel Parking Services rejected my appeal and lied in their response claiming that, as part of my appeal, I had advised that I had claimed I had put the wrong registration number in. This is completely untrue. I have a ticket with the first four numbers of my car registration which match my car registration.

    Out of interest, I am an IT contractor on a day rate whcih I can evidence to a court. If these scammers do eventually take me to court can I charge my day rate and expenses against them and would they have visibility of this ahead of the court hearing? Having to pay me a days salary might put them off progressing in case they lost. Is there a limit?

    £95 per day, unless you can convince the judge that the claimant has been wholly unreasonable.
