Parkingeye — paid the charge, but still being threatened

I parked at a hotel car park. I paid the parking charge using the paybyphone app. I have a receipt to prove this. And the charge is shown on my bank statement.

Parkingeye sent me a parking charge letter, and I appealed on the ground I had already paid at the time. They denied the appeal (?!) and I eventually got a Letter Before Action. Once again I wrote to them, proving that I had paid the charge at the time.

They refused to accept this and are continuing to threaten me with court action.

I absolutely will not pay and will see them in court if it comes to it. In the meantime I have written to the hotel to ask them to get Parkingeye to back off.

Has anyone else been in this position?

I am not challenging the right of the hotel to charge for parking. Nor the right of Parkingeye to chase non-payers.

But that is not the situation here. I paid.

You may need to respond if you've received Letter before Claim. Read NEWBIES THREAD Announcement Post 2 Small Claim.

Email your MP explain your situation and ask him to help you resolve the issue with PE and hotel.

Did you pay for the correct registration?

Have PE sent you the 'Letter Before Action' (that's not a term we see here very often, an old bit of phraseology from some years past)? Or have they farmed it out to DCB Legal?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yes. Everything matches up. I don’t know why they’re still pursuing it. They won’t say. They just keep saying “your appeal is rejected”.

Sorry. My fault. The letter was from PE and was headed “Letter Before County Court Claim”.

Do what the NEWBIES thread says for Parking Eye LBCCCs, which are covered especially.

What did the Hotel Manager say when you asked them to step in and email ParkingEye to simply cancel the PCN, as they can do at any time before court action stage?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
