How can they refuse to accept you've rejected the original car if you put it in writing?  I assume you did so in an unambiguous way.  Especially as you say they're going to replace it with a like for like.

Or, are you having to play Ford politics; a rejection is bad for their customer service figures but a replacement is OK.

This was the crux of the email (names have been changed to protect the innocent):

    Hi Bill,

I writing to you to formerly reject my new Ford Explorer Premium AWD (<number plate>).

I have not taken this decision lightly, but following nearly 11 weeks without a resolution to the fault experienced on the day of collection (21st November 2024), I have no longer have any faith in this vehicle.

After being a dedicated customer for 11 years, and having purchased 7 new motor vehicles (including 2 for my fiancee) in that time, I cannot begin to describe the disappointment I am feeling with Ford Motor Company right now.

    Kind Regards

I even went in to the dealership and signed a form for the proposed swap out process they have they.

I am at a total loss on what to do next. But I guess I will speak to the Citizens Advice or a Lawyer to see where I stand.

I have also asked for a name within Ford who I can speak too because the according to the Sales person, the dealership keep pushing for the swap (both Sales and Service) but it they're being ignored.

Cancel the sale and buy a 2025 Jaguar for £40k!  That save you a good bit.

It's not up to Ford to reject your request.
You bought from a dealer and that's who your contract is with.
It's the dealer that needs to sort it out

Your contract is with the dealership only. You have rejected the car, do not get involved with any swap. A simple rejection and all your money back. You need to be firm.

I am confused…you say they have rejected the rejection in favour of a swop but I thought that is what you would be happy with.

I writing to you to formerly reject my new Ford Explorer Premium AWD (<number plate>).

    FORMALLY.

Formerly reject it means you did it previously.

Formal event - you wear black tie
Former event - you went last year

I even went in to the dealership and signed a form for the proposed swap out process they have they.
And that's where the confusion has arisen. The swap-out will be within the existing contract, which you'd just told them you wanted to rescind.

One thing to think about here.
If you reject & go for a new car. Is the price going to be over £40K, given the slim odds of getting one before 1st April. meaning it would attract the enhanced 🤬VED rate.

Swapping would in effect be the same, as it would be a new registration.

Goddamn the english language and auto correct!

I just followed up with a correction to my original email stating that I assumed the sentiment of the original email was as we verbally discussed before I sent it

The dealership have said it would be a like for like replacement with no additional cost - only time will tell
