Alliance Parking - Hire campervan owner

Having read the newbie page unfortunately I cannot find something applicable - so asking for help please!


I rented out my campervan through agents and have received 2 final demands for 2 separate charges - one 14 months ago and another 7 months ago.
Both hirers are from abroad which could explain why they are after me not the hirer.
Alliance Parking have not contacted the hirer despite having details.
For both I filled in the  driver/hirer identification form with name and address of hirer(s) within the 28 day time frame - I also enclosed a hire agreement to verify dates. The only request for information was name and address.

They are now demanding that I pay having quoted -
 Parking Operators have the capacity to hold the Registered Keeper liable for a Parking Charge under The Protection of Freedoms Act 2012 Schedule 4; I have provided a link for your convenience: 

We refer you to section 13 of said act, as this relates to hire vehicles; and it details scenarios that prevent a hire company from bing held liable for a Parking Charge. It is effectively a ‘to do’ list for hire companies to release them from liability.

To summarise, a hire company must provide the following by post within 28 days of the Notice to Keeper:
  • A statement signed by or on behalf of the vehicle-hire firm to the effect that at the material time the vehicle was hired to a named person under a hire agreement.
  • A copy of the hire agreement
  • A copy of a statement of liability signed by the hirer under that hire agreement*
Note: The ’statement of liability must contain a statement by the hirer to the effect that the hirer acknowledges responsibility for any parking charges that may be incurred with respect to the vehicle while it is hired to the hirer.

As we did not receive a signed hire agreement, encompassing a Statement of liability; you remain liable for both these charges. 

In light of the above, we look forward to receiving your payment by return, you should have a process in place for reclaiming payment from your customers.


Is this right? - there was no mention of this on their charge notice - only - 
Hire / Lease companies 
We have opted out of the Memorandum of Understanding (MoU) between The BVRLA & The IPC. Hence we will not process or respond to liability transfer requests that do not adhere to the applicable legislation. Therefore we recommend that you settle the payment and pursue reimbursement for the Parking Charge from your customer.

    Just ignore them/him. Waste of space IMHO.

    Awful company IMHO and he (bouncy Kev : search the forum!) often attempts to stop keepers appealing yet wants to hold keepers liable. Basically he's just after your money.

    He isn't right because when a PPC knows the name and address of the driver, the right to pursue the keeper falls away.

    Sit tight. Do nothing except the below.

    By going confidently into the 'ignore' stance, the only steps to take (because you MUST check every letter) are:

    - Tell them if you move house within 6 years.

    - Ignore the tedious £170 threatograms shown in pictures in the 4th post of the NEWBIES thread.

    - Come back if you get a solicitor's LBC as per the 2nd post of the NEWBIES thread.

    Nobody pays a penny unless a Judge says so. There is no risk AT ALL in defending a court claim. No CCJ. No bailiffs.
