I parked in a private car park, owned by Excel parking services, which I paid on the way out. I did that twice in one day. They sent me a letter fining me and saying I hadn’t paid, I sent them the card details and they said I should have paid at the start. Then they started hassling me and sending me lawyers letters and saying I owed them more. It’s now escalated to them taking me to court for the money. I am trying to write a defense and I would like some help on what I should include. The charges have swelled to £449.92. I have given an acknowledgement of service. Surely having made a decent effort to pay must count for something? This could have been solved if they didn’t try to fleece me.

What is the Issue Date on your Claim Form?
Can you please show us a picture of the Particulars of Claim - with all your personal detail hidden of course.
Upon what date did you file an Acknowledgment of Service?
Your MCOL Claim History will have the definitive answer to that.1 -
Excel will not own it, probably a private company
Recently there has been a lot of publicity about paying late, but Excel Parking are cancelling cases where full payment was made after entry, before exiting the property

Have you done the AOS online yet ? On MCOL ? What date was it done ? ( you were asked that question earlier)
You are dangerously close to a default CCJ so a defence needs to be submitted ASAP if the claimants havent pulled the trigger, but I think that your deadline will be 4pm on Monday 17th

Yes have done AOS was done 2/2/25. Both PCN’s were on the same date. I used the car park twice in a day.

I bet that the POC dates are incorrect
Use the recent paragraphs 2 , 3 & 3.1 as seen in other recent threads this year by DCB Legal and ECP, have them checked below and then slot them into the template defence replacing the existing 2 & 3
Should take you 20 minutes at most
Dont look at anything older than 2 months2 -

The POC is the Particulars of Claim, bottom left, I doubt that the pcns were actually issued on the incident, but later, several days later in fact
This means that the issue date listed on the claim form was incorrect for both, check the dates and see
Its highly unlikely that 2 windscreen pcns were issued to the vehicle by a person on the incident date

You filed an Acknowledgment of Service('AOS') on the very last day possible, and now you have left filing a Defence ridiculously late.With a Claim Issue Date of 14th January, and having filed an AOS in a timely manner (just), you have until 4pm on Monday 17th February 2025 to file a Defence.
That's just a couple of days away.To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an AOS has been filed, the MCOL website should be treated as 'read only'.2
