I am dealing with an identical PCN at this location on an other forum. Having gone to POPLA, PE has submitted their evidence pack and the following has been noted after reviewing their landowner contract:The original contract was from 30th August 2016 and was valid for 24 months with no automatic renewal terms. Therefore the original contract expired on 29th August 2018. Then they provide an "amendment" to this now expired contract, dated 13th September 2021 and signed on 16th September 2021 with a stated term of 36 months valid from the "effective date", without specifying what the "effective date" is, but even assuming it was from the latest of the two signatures, 16th September 2021, that amendment to the already expired contract also expired on 15th September 2024.
If your PCN was issued after 15th September 2024, ParkingEye had no valid contract with the landowner, meaning they had no legal authority to issue the charge and that is only assuming that the amendment to an expired contract may be considered valid if both parties continued to act as if the contract remained in force, potentially forming an implied contract by conduct.
The PCN is unenforceable.

Thank you for this @LDast this is incredibly helpful. My PCN was issued on 8/2/25.I agree it looks like PE had no contract in place since 15th September 2024. However, the terms and conditions of their contract with Atmore Developments are impossible to read in the scan. It may be that there is something in the terms of the contact that allows it to continue past the end date of the contract, under an implied contract?Given the steps I have taken to date, what would you recommend is my next move? Should I go the POPLA route, with the wording that you have suggested in the other forum thread?0
