Fine sent to Salary sacrifice scheme company

hi the context is of a car on a salary sacrifice scheme. The car was parked in a disabled area for about 5 mins. The driver enquired on the day and no fine was supposedly made. The parking company had an employee there full time making fines! Few weeks later the salary sacrifice scheme sends a letter saying to pay £100, as the deadline to pay £60 had passed, and if the parking company does not change the fine to the driver's name they will pay and take money away from the driver's salary via the company. Is it OK to wait for the parking company to 'rename' the fine? It hasn't happened in a month or so. Thanks!

It is not a fine.
If the salary sacrifice scheme company is the registered keeper, the day-to-day keeper should instruct them to transfer liability to the hirer/lessee (the day to day keeper) using the tear off strip on the NTK and send it to the PPC.
This needs to be done asap along with an instruction not to pay the charge under any circumstances. Once the salary sacrifice scheme company has done this, they can no longer be held liable.
If they fail to transfer liability, they will remain liable.
Whether they can pay the charge and bill the d-to-d keeper will depend on what the salary sacrifice scheme contract says.
Alternatively, the day to day keeper can try to appeal this using one of the edna basher letters that can be found in the sticky Announcement for NEWBIES, but this may not work if the appeal deadline has already passed. This will normally be 21 days for an IPC member, or 28 days for a BPA member, so the d-to-d keeper needs to act quickly.
The driver's identity should not be revealed by either party under any circumstances.
This assumes the driver had a valid reason to use an accessible parking bay.
