Clean break order

I divorced my ex 4 years ago and have since remarried.
We had no property or dependants when we divorced.
I've been reading about a clean break order and wondered whether I should apply for one? The trouble is my ex and I do not have contact and I doubt he'd agree to it.

Are you saying you divorced without a financial order (as this typically contains a clean break)?
If so then there was no agreement or formal division of assets? You say you had no property, but assets can include savings in bank accounts, pensions, assets like cars, etc.
Certainly if there was no financial order I'd consider getting one done for peace of mind. You wouldn't want to win the lottery and have your ex appear back on the scene out of thing air.

That's correct. When we split i walked away with nothing.

You are going to need to find your ex as without the consent order he can come back and claim half of everything that you currently have, or might have in the future.

You may end up having to go to court again. You need proper legal advice. It may cost but it could cost more to sort this out in a decade when you have more assets. Remember, marital assets include stuff like pensions, not just bricks and mortar.

Get a financial clean break order it's the only way to get certainty.
Otherwise those claims remain live unless he/you remarry (remarried party's claims then limited to pensions only)2
