"This is an appeal by the registered keeper - No driver details will be given. Please do NOT try the usual Group Nexus Trick of asking for driver details in order to get around the fact your NTK does not comply with POFA. As there is no keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @ POPLA. Please therefore cancel the notice or issue a POPLA code where you will auto withdraw"

Disappointed that I never go to use the POPLA appeal


No evidence of Landowner Authority - the operator is put to strict proof of full compliance with the BPA Code of Practice

for information this camera trap was on Ovington Dr Southport, a small row of shops ..... If I can get caught out here any one can / could.

    Can someone please advise or confirm is the quote used by Grizebeck above the correct "one line" appeal to sort out SMART PARKING SCAM ATTEMPTS?
    I read to NEVER give out the drivers name or address and to appeal using this one magic line on the SMART PARKING WEB SITE.

    Since joining the IPC a couple of months ago, and thus removing POPLA from the equation, that appeal line is unlikely to work any more. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    That appeal point plus non compliance with Pofa2012 has recently worked with IAS appeals, so can be worth a punt, probably better to have both points in an IAS appeal,  so as mentioned in this recent thread about POFA

    Yes it is worth a try at IAS as long as you push the point that there's no landowner authority.
