Euro Parking Services - I was going to give up

Firstly, thank you all for all the information on the threads. 

My situation: Car parked on a car park, paid, receipted. PCN received specifying vehicle entered one hour earlier than the car actually did!!!!! Parking contravention stems from the erroneous time of entry, to the correct time the vehicle left the car park. Appealed, heard nothing. Four months later I get a debt collection letter, which is where we are up to. 

Having read comments about IPC, IAS, the fact that the timeframe for NTK was complied with, I think I am just going to have to fold as the registered keeper. I have no meaningful way of contacting anyone there and I think the amount to be paid vs the time I have spent on this already is disproportionate. 

I typed the above earlier today. I had a change of heart and I have drafted a letter to the company which I will send. It has to be in hard copy format because their electronic systems seem to be geared towards the payment of the PCNs and getting more land on the books to be used for parking. 

I have no idea where this will go but it's just wrong and, though 'worried' I would be angry and possibly allow that to permeate my personal life - so, worry it is over anger. 

I used the template letter but adapted it to say how little I have had from them and to say that if they don't reply within 14 days, they are getting shopped to DVLA for these practices, and I will be willing to take it further if necessary. 

Let's see what happens [nailbiting].

  • And when I say practices above, I mean just the 'error' as I have called it. I haven't gone full on with an accusatory tone / phraseology.

    Ignore the powerless debt collectors letters,  they cannot do anything other than send you hamster bedding 
  • Another change of heart. I have been through my Appeals letter and I think it does too much. So I am reverting to the template with a couple of amends. 

    Importantly, I have read through the below thread. The NTK I received is SIMILAR but not exactly the same. However, mine also does not mention that it complies with POFA. So should I raise that in my appeal? (and likely repeat it ad infinitum in everything I send to them?).

    Wait for the letter of claim then Arkell v Pressdram it.

    They are going to have to prove with photo entry and exit and on the situation described they will be unable to.
  • So: "Please let me know what your client's response would be to [insert expletives here]". Though I can be terse in writing, I'm not sure I can be that terse!!!LOL

    The time entered on their Parking Charge Notice is entered into an editable box, and the photograph does not appear to be time stamped. It may be, but it's unknown because I don't have the full photograph. I also have a series of receipts saved electronically demonstrating that regular afternoon parking of various vehicles is ALWAYS at the same time, for the same reason. They stretch back over a year and a half or so.

    So the car park uses ANPR. If they’re using an editable box on a form, how can the ANPR detect that the car was there at that time?

    @NorbertVonTishenbaum well yes, a punchy reply is the point.  Still, a sort of grudging respect for Ian Hislop for sending that legendary missive.

    Everyone is different but if you have the nerve you can invite them to issue if they want, but they should know you weren't there, can prove that and will seek costs accordingly. I'd want them to look at and disclose entry and exit photos also.

    If there is *any* means of a vehicle leaving through an uncontrolled entry/exit there is no proof of parking at all, as suggested.

    Thanks for your reply. There is no controlled entry / exit. Having been there to take photographs (I have purposefully not been parking there for a number of months after the issuance of a PCN; I don't trust them), the land is in a pretty bad state. There is rubbish there, the bay markings have basically disappeared, although there are 8 signs, the text on them is TINY. I took a photo from approximately head height, looking upwards, and the font is tiny. 

    I have just drafted a letter to the parking management company and also to the debt collector. I will start preparations for a defence (because it seems from searching the forum it will end up at that stage in the least), and once complete, I will invite them to serve / issue. I appreciate I may have to update my defence at some stage, but I'd rather get the meat of it out of the way, have you kind people review it (if you would), and then just top and tail from there. 

    On the point of 'kind people' - I obviously have no idea who you, @Gr1pr, @Coupon-mad, and many others are. I have no idea what you do for a living (guessing something affiliated with the law). I don't know what drives you. All I know is that having all this information to hand, having you guys there as a sounding board and reviewing board is appreciated.....certainly by me. It's truly astounding how many people you've all helped when you start reading into this type of predatory practice. Thank you. 

    Whether this goes well or not, I will be writing to my MP and I will continue to do so with regularity. It's absolutely astonishing the flagrant disregard for the potential of conflicts of interest that may arise when you dig into the ownership structures, common shareholders, POSSIBLE phoenixing (of any number of Companies), potential for shadow Directors etc.

    sorry i had misunderstood this to be an ANPR site. Sorry if that was incorrect.

    Google location or car sat nav etc may assist in helping you to show that you were elsewhere prior to the parking period charged for.
