So does that count for my pension as well which is £117 a month this is also being taken off uc?
Yes deducted in full. Your ESA will also revert to New style ESA automatically.
  • Thankyou poppy, am I better off on contribution based esa rather than income related as it seems a bit biased towards income related, and I presume it's pointless my partner claiming income related esa as that too would be deducted from uc

A person can't claim IR ESA any more UC had/is replacing it.

Even if you hadn’t claimed UC you weren't entitled to Income Related ESA because you live with a working partner.

  • Thanks again poppy, I am now confused with doing the journal on uc for self employed, my partner is getting carers element for myself but any idea what the earnings threshold is before deductions is as I have read about the minimum income floor, and losing 55p in the £1 but what can she earn before deductions thanks

As your partner is claiming carers element they can’t be found to be gainfully self employed so the minimum income floor will not apply.

As you have LCWRA you will also have the work allowance, this means so of the earnings you or your partner receives will be ignored before deductions apply. If you claim for help with the rent it will be £404/month, if you don’t it will be £673/month. For every £1 of earnings received over those amounts your UC will reduce by 55p. (55%)
  • OK, as it stands she earns about £100/£150 a week as its restaurant not guaranteed so whatever is left at the end of the month is hers usually about £600 so she would lose 55p in the pound for all of this?

Yes for any earnings above the work allowance. For example, if someone’s earnings are £1000/month and they claim for help with the rent their work allowance would be £404/month - £1000 = £596 x 0.55 = £327.80, which is what the UC would reduce by.
  • OK,, at the moment my esa support group and my pension are being deducted from our uc claim, is this off the £673 as we don't get help with housing or a separate thing all together

Those are unearned income so still taken off UC £1 for £1.
