GCTT Letter Scotland

Hi. I’ve read all the recommended threads and I know my case is no different to anyone but I’m confused as it seems lots of folk saying ignore and some others saying to appeal. 

Ticket originated from Smart Parking due to overstaying free minutes (hands up - I did overstay) and I’ve had a few letters which I ignored but recently got one from GCTT “warning notice of transfer to solicitors”. 

I’ve ignored and made no contact at all but the letter says “may result in you receiving a county court judgement against you”. 

Do in continue to ignore? Are the balifs likely to appear at my door? 

Not sure my nerves can take it and I might pay the £160. 

Any advice specifically for me would be greatly appreciated. Not sure I can appeal as I did overstay.

    No bailiffs will come knocking 

    Put the letters in a drawer until after the 5 year deadline  ( stop reading them too  )

    Thank you! I’ve binned the previous letters (before I checked here) will this be an issue?

    Definitely not,  dont overthink this, just ignore the debt collectors letters 

    In the unlikely event that you receive letters from say the sheriff office or Scottish justice system etc, then and only then come back to this thread for assistance 

    But that wont be happening because the pcn is probably £90 or £100  ( not £160  ) , well below the £300 threshold in Scotland 

    More chance of me winning Euromillions than you ever getting a problem,  especially not with Smart parking

    OP... for yours and anyone else searching through these threads, please try and digest this in order to allay your unfounded fears of bailiffs, irrespective of the fact that this applies to English/Welsh law:

    Why no bailiff can just "knock on your door"

    1. County Court Judgment (CCJ):

    • A bailiff (enforcement agent) can only get involved after a creditor has obtained a CCJ against you in a county court.
    • If the CCJ is under £600, the creditor cannot transfer it to the High Court for enforcement by a High Court Enforcement Officer (HCEO). Instead, enforcement would remain under the county court's jurisdiction.

    2. Threshold for High Court Enforcement:

    • If a CCJ is over £600 (including fees and interest), the creditor can transfer it to the High Court for enforcement by an HCEO. This is a common method because HCEOs tend to be more effective at recovering money.

    3. Cost-Benefit Analysis for Creditors:

    • For CCJs under £600, creditors may find it uneconomical to pursue enforcement through county court bailiffs, as they are generally slower and less effective than HCEOs.
    • As a result, creditors may opt not to escalate enforcement for small amounts.

    4. Private Parking Charges and Bailiffs:

    • In the context of private parking charges, no bailiff action can occur unless the parking operator has gone to court, won a case, obtained a CCJ, and you fail to pay the judgment within the stipulated time (usually 30 days).

    So, no bailiff will come to your door for a debt under £600 unless the creditor deems it worth pursuing through county court enforcement. However, even if the debt is over £600, bailiff involvement only happens after a CCJ is issued, and enforcement is transferred to the High Court.

    Bear in mind that in Scotland the justice system is different and it would be a decree , via the Sheriff's office,  so the enforcement may be different 

    But it always starts with a claim,  in Scotland using the simple procedures avenue 

    Ccjs and county courts are in England and Wales
